Order Before: WEICK and KEITH, Circuit Judges, and PHILLIPS, Senior Circuit Judge. Appellant Raymond A. Uren submitted an application for black lung benefits under the Federal Coal Mine Health and Safety Act of 1969 on January 11, 1971. The Secretary's decision denying Uren benefits has been reviewed by the district court twice. The first time, August 31, 1977, the case was remanded to the Secretary upon request of the government because the tape of the administrative hearing was lost. The case came before the district court again in September 1978, for review of the Secretary's denial. At that time the government filed a motion for judgment on the pleadings. On November 28, 1978, the district court sustained the government's motion for judgment on the pleadings, finding that the Secretary's decision denying benefits was supported by substantial evidence. The appellant then filed this appeal.
